FCC Opens Proceeding on AT&T-T-Mobile Merger

The Federal Communications Commission has opened a docket on the $39 billion merger between AT&T and T-Mobile USA. The proceeding is WT Docket No. 11-65.

AT&T has not yet filed its application with the FCC for permission to acquire T-Mobile USA from Deutsche Telekom. The FCC said it would release a public notice after that occurs.

The Washington Post recently reported that AT&T has filed its application for antitrust review at the Department of Justice. AT&T has said it aims to file its application with the FCC on April 21.

Both the DOJ and FCC are expected to closely scrutinize the merger under antitrust law and other federal law.

As part of its review of the merger, the FCC has adopted procedures to limit public access to proprietary or confidential information that may be filed in the proceeding. The agency said it expects that such materials will be necessary to develop a more complete record on which to base the Commissions decision.”
