Level 3 Loses Patent Infringement Suit

Level 3 Communications Inc.(LVLT) said Friday it probably will appeal a jury verdict that didn’t find in its favor.

Jurors in a patent infringement case decided content delivery networks (CDN) provider Limelight Networks Inc.(LLNW) did not steal intellectual property Level 3 acquired when it bought Savvis Inc. two years ago.

The court did, however, reject Limelight’s contention that the patents weren’t valid in the first place.

Grant van Rooyen, president of Level 3’s Content Markets Group, said the carrier is disappointed in the jury’s non-infringement findings.

“We are considering our options regarding post-trial motions and an appeal,” van Rooyen said. “Level 3 continues to take intellectual property seriously as the best protection for innovation, and we will continue to protect our investments in human ingenuity, time and capital on behalf of our stockholders.”

Limelight, of course, said it was pleased with the verdict. Jeff Lunsford, Limelight’s chairman and CEO, called the decision “a positive development for our shareholders, employees, customers and partners.”
