A federal appeals court today denied Vonage Holdings Corp.’s request that the jury verdict against it be thrown out and that the company get a new trial.
“We believe that Vonage has not yet made a sufficient argument to justify a new trial,” said analysts for investment bank Stifel Nicolaus in a memo to clients.
Instead, the court said the IP telephony provider – which a jury found to have infringed on three Verizon Communications Inc. patents – may include the issue in its appeal brief, due May 9.
Oral arguments before the appeals court still are scheduled for June 25.
